These Terms are governed by the laws of Vietnam. Disputes will be resolved by the competent courts of Vietnam. If any provision is found invalid, the remaining terms will still apply. Failure by Potique Hotel to act on a breach does not constitute a waiver of future enforcement.

2. GENERAL TRANSACTION CONDITIONS (ARTICLE 32)
a) Best Rate Guarantee Policy:
We guarantee to refund the difference if you find a lower room rate for your reservation on another online booking site.
If you find a better rate than what is listed on the Potique Hotel website, please contact us either during your booking or within 48 hours after completing the booking. Simply provide us with a link to the booking confirmation, a screenshot showing the lower rate, and ensure that the link is still active at the time of review.
Conditions of the Best Rate Guarantee:
– The better rate must be for the same hotel, room type, and included benefits (e.g., breakfast included or not).
– The rate must be for the same check-in and check-out dates.
– The rate must include the same booking and cancellation conditions.
– The rate must be available for immediate booking confirmation.
Note: You do not need to make a reservation on another website — just show us the price difference between our website and other platforms.
b) Cancellation, Modification, and Refund Policy:
If guests wish to cancel or modify their reservation, they may do so either directly on the website where the booking was originally made or by contacting the property using the contact details provided in the booking confirmation email.
Guests are kindly requested to make full payment for the room at least 7 days prior to check-in.
If the room is canceled within 7 days before the check-in date or in the event of a no-show, the full amount paid or deposited will be forfeited.
Failure to contact the hotel or show up before the check-out time on the first night will result in cancellation of the remaining nights.
In cases of force majeure such as natural disasters, war, epidemics, or government regulations, or if the guest has legal restrictions, the hotel will notify the guest of the status of their reservation and shall not be liable for any compensation.
If the guest has paid or deposited in advance and then wishes to cancel or modify the reservation, the refund will be made in accordance with the terms and conditions of each reservation.
Requests for cancellations or modifications beyond the stated policies may be subject to charges according to the hotel’s policy.
If the guest cannot meet the free cancellation/modification conditions due to force majeure, they are encouraged to clearly state the reason to the hotel for refund consideration.
c) Booking Process:

Step 7: Potique Hotel will send a booking confirmation email containing details such as guest name, rate, check-in and check-out dates, and deposit/payment instructions

d) Extra Charges:
BREAKFAST & EXTRA BED SURCHARGE POLICY
Maximum occupancy is 3 adults or 2 adults + 2 children under 12 years old per room (except the Presidential Suite). Surcharges apply as follows:
– Free breakfast and stay for up to 2 children under 6 years old sharing a bed with parents.
– 1 child aged 6 to under 12 + 1 child under 6 sharing a room with 2 adults: breakfast surcharge applies to the child aged 6 and over. Extra bed surcharge applies if requested.
– 2 children aged 6 to under 12 sharing with 2 adults: surcharge for 1 extra bed and breakfast surcharge for the other child.
– Children aged 12 and above are considered adults.
EARLY CHECK-IN / LATE CHECK-OUT SURCHARGES
Check-in time: 14:00 | Check-out time: 12:00 noon
Early check-in and late check-out are subject to room availability at the time of arrival or departure.
Guaranteed early check-in or late check-out surcharges are as follows:
– Early check-in before 06:00: 100% of the Best Flexible Rate
– Early check-in from 06:00–10:00: 50% of the Best Flexible Rate
– Late check-out from 12:00–15:00: 30% of the Best Flexible Rate
– Late check-out from 15:00–18:00: 50% of the Best Flexible Rate
– Late check-out after 18:00: 100% of the Best Flexible Rate

f) Responsibilities of the Hotel and the Customer in Each Transaction
Hotel Responsibilities:
Potique Hotel is committed to providing secure and efficient access to the website and its services, minimizing risks, and resolving issues promptly. However, the hotel reserves the right to suspend the website without prior notice, particularly for technical maintenance, and shall not be held legally liable in such cases.
Customer Responsibilities:
Customers are fully responsible for their own needs and choices regarding services selected on the website. Potique Hotel shall not be held liable for any false or fraudulent information provided by customers. Customers are also responsible for all actions taken through their accounts, including bookings made on behalf of others or minors. Customers must notify Potique Hotel immediately if they detect account misuse, fraud, or errors.
By using the website and its services, the customer agrees to comply with current regulations and Potique Hotel’s general Terms and Conditions. In case of any violation, the customer will be liable for any damages caused to the hotel or third parties.
Specifically:
– Any failed, incomplete, or fraudulent booking or payment due to the customer’s actions will result in cancellation of the service reservation without intervention from Potique Hotel.
– Customers will be denied service if their behavior is deemed disruptive to the premises or to other guests.
– Smoking is strictly prohibited in non-smoking areas and in guest rooms.
– Customers must not disrupt hotel operations or jeopardize the safety of the property or other individuals. Any behavior that violates public order, hotel rules, or moral standards will result in the guest being asked to leave without any refund or compensation. If no payment was made in advance, the customer must pay for any services used before departure.
– All minors must be accompanied by an adult and must present identification. If accompanied by an authorized person, proof of parental consent may be required.
– Customers agree not to use any intellectual property such as documents, images, music, audiovisual content, software, or video games in any way that infringes copyrights or ownership rights.
– Customers are liable for any damage they or their guests cause on the premises and must bear the cost of repairs or penalties for non-compliance with the rules.
3. DELIVERY OF SERVICES (ARTICLE 33)
a) Service Provision Methods:
Customers may book accommodations through email, the Potique Hotel website (potiquehotel.com), online travel agencies, phone, or in person at the hotel.
b) Estimated Delivery Time:
The hotel will respond to booking requests within 24 hours after checking room availability and other factors (maintenance, natural disasters, epidemics, etc.), excluding public holidays and weekends.
c) Geographical Limitations (if any):
There are no geographical restrictions on service delivery at the hotel.
In the event of a dispute after booking, customers may file a complaint directly via the hotel’s hotline. Complaints will be received, forwarded to the relevant department within 24 hours, and resolved as soon as possible.
In force majeure situations (natural disasters, war, epidemics, government regulations, legal restrictions related to the customer), the hotel will promptly inform the customer of the reservation status and shall not be liable for compensation.
If a customer cancels a booking and meets the cancellation conditions stated, they will receive a refund according to the booking’s policy. Requests for cancellations or changes outside of the defined policies may be subject to fees as per hotel policy.
If the customer fails to meet the cancellation/change conditions due to force majeure, they may submit a written explanation for the hotel’s review. Refunds will be based on each reservation’s terms and will be confirmed by hotel staff via email.
4. PAYMENT METHODS (ARTICLE 34)
Customers provide payment information to:
– Prepay for reservations
– Guarantee bookings
The hotel may accept various payment methods including international cards, domestic cards, bank transfer, and cash. If using a credit card to guarantee or prepay, customers may be required to present that card at check-in along with valid identification to prevent fraud. If no prepayment is made, the hotel may request a deposit or bank transfer as a guarantee for services used on-site.
Potique Hotel partners with the ONEPAY payment gateway, which accepts Visa, Mastercard, American Express (Amex), Diners Club, JCB, and Discover cards (subject to change). The card’s validity will be verified and may be declined for reasons such as theft, blocking, over-limit, or input errors. If an issue occurs, the customer must contact their bank or the hotel to confirm the reservation and payment method.

If the customer does not check in on the first night without notifying the hotel, the entire reservation will be canceled, and the hotel may release the room to other guests. Any prepayment will not be refunded or compensated.
If the reservation is guaranteed by a credit card or pre-authorized by the bank, the hotel will charge the first night (including taxes and fees) to the provided card according to the terms and conditions.
